1. Introduction
These Terms & Conditions form the agreement between you (“you”, “the client”) and Zest Marquees (“we”, “us”, “our”, “The Company”) for the hire of marquees, structures, furniture, lighting, power equipment and associated items (“equipment”).
They are written in clear, plain English, in keeping with our values: straightforward communication, transparency, and safety first.
Accepting a quotation and paying the deposit confirms your booking and your agreement to these Terms.
2. Quotes, Availability & Booking
2.1 Validity
Quotes are valid for 30 days unless stated otherwise.
2.2 Booking Confirmation
A booking is confirmed when:
• You accept the quotation in writing, and
• A 30% deposit is paid.
We will then confirm your booking in writing. A binding contract will exist from this point.
Note –The deposit payment to secure your booking and is held as a retainer against loss, damage or cancellation and will be returned to you after the hire period. The total costs (per the quote) are due 14 working days before the hire date.
Payment Method
Payment is requested by bank transfer using the bank details shown on our invoice and below.
Card payments may be accepted on request via a secure payment link. Prices quoted are based on payment by bank transfer and we reserve the right to adjust the amount payable where alternative payment methods are requested.

2.3 Final Order Payment
The total costs (per the quote) are due 14 working days before the hire date (or immediately for late bookings).
2.4 Goodwill 7-Day Cooling-Off Period
Zest Marquees offers a 7-day goodwill cancellation window after booking during which you may cancel with a full refund of the deposit, provided installation has not yet begun.
This window is optional and offered as a courtesy; it does not replace our main cancellation policy.
2.5 Consumer Law Compliance
We actively instruct customers to review these Terms before the contract is formed, in line with MUTA guidance.
3. Hire Period
The hire period starts when we complete installation on the agreed date and ends when we return to dismantle and collect the equipment.
We may install earlier or collect later, depending on routing, scheduling and weather; your hire price is unaffected.
You are responsible for the equipment from installation until its collection.
4. Site, Access & Ground Requirements
4.1 Accurate Site Information
To install safely, we require accurate, up-to-date information regarding:
• Ground conditions
• Slopes or uneven surfaces
• Access routes
• Overhead power lines
• Underground utilities (pipes, drains, cables)
Stakes may penetrate up to 1 metre, so all services must be disclosed.
4.2 Site Plan (Where Required)
For larger structures or complex sites, we may request a measured site plan showing boundaries, services, obstructions, and the proposed marquee position.
Failure to provide an accurate plan may result in additional charges or cancellation.
4.3 Access
You must ensure clear access for our vehicles, sufficient space to manoeuvre, and a clear, level working area.
If access issues cause delays, cleaning/clearing or additional labour, extra charges may apply.
4.4 Delivery Positioning
You or a representative must be present to confirm positioning. Otherwise, we will position the structure where we believe is suitable.
Repositioning after installation is chargeable.
4.5 Ground Damage
Some minor ground indents, stake holes or flattening of grass are unavoidable. We are not responsible for restoring the ground afterward.
5. Delivery, Installation & Collection
5.1 Safety During Build and Breakdown
For everyone’s safety: No one may enter the marquee or work area while it is being erected or dismantled.
5.2 Equipment Acceptance
• Business clients: A representative must inspect and sign off equipment.
• Consumer clients: You have a reasonable period to inspect and report any issues
All furniture will be placed in the centre of the marquee to allow the client to lay out to their desired plan.
5.3 Set Up / Collection Arrangements
We will agree on a mutually convenient date / time period for setup & collection. We cannot guarantee specific times, but we will contact in advance to advise of the expected arrival time. If our team must wait due to access delays or a site not being ready, we may charge for waiting time.
5.4 Collection
All furniture and extras must be packed, stacked, dry and placed in one collection point. Clearing charges apply if items are not ready.
6. Weather, Safety & Operational Requirements
6.1 Severe Weather
We follow MUTA’s Wind Management Plan and may delay installation, modify the structure, refuse to install, or dismantle early if conditions become unsafe.
Safety is our overriding priority.
Hirers will be liable for the full hire fee; therefore must be aware of this possibility, especially during the winter months.
6.2 Your Responsibilities in Bad Weather
You must keep doors/walls closed in high winds, prevent snow accumulation, and ensure guests do not interfere with fixings.
You must follow the instructions in the Wind Management Plan.
6.3 Heaters, Cooking & Fire Safety
You must not:
• Use open flames in or near the marquee
• Place heaters closer than 6 ft to walls
• BBQ within 15 ft of the structure
Any additional equipment (lights, décor, fixings) must be approved by us.
6.4 Electrical / Power Supplies
If you are providing power, it must be safe, certified, and within 15 metres of the marquee.
Generators should be tested within 2 hours of delivery.
When hiring mechanical items with moving parts (e.g., Generators), the Company always recommends a backup solution in case of mechanical breakdown.
7. Equipment Care & Security
7.1 Your Responsibilities
You must:
• Use equipment only as intended
• Prevent unauthorised access or misuse
• Keep equipment secure at all times
• Not move or adjust any part of the structure
• Report any damage immediately
• Not attach items using tape, adhesives, nails or fixings. A charge will be levied for cleaning any residue
7.2 Insurance
You must insure the equipment for the hire period against theft, fire, vandalism, weather damage and accidental damage.
A Damage Waiver may be available, but this does not cover negligence or misuse.
The hirer will be responsible for the damage to a marquee and orther equipment on hire. The company has full public liability insurance of £5 million.

We will not hold you responsible provided you can prove reasonable care has been taken to prevent damage or loss. Security of unattended equipment is the hirer’s full responsibility, especially is the site is not the hirer’s land. We strongly advise the hirer to arrange security for the duration of the hire as losses will not be covered by the Company’s insurance.
7.3 Missing or Damaged Items
Missing or damaged items are charged at full replacement value, not hire value.
Unless otherwise stated in the quote, replacement/refill costs will be charged to the hirer for fuel used for generator hire, indirect heat supply and any other equipment hire that requires fuel. All furniture and equipment hired will be counted in and out, with any shortages charged to the hirer.
8. Ownership, Inspection & Recovery Rights
All equipment remains the property of Zest Marquees.
We may access the site at reasonable times to inspect the equipment, and may enter the site to recover equipment after hire or if the contract ends early.
You may not sub-hire or part with possession of the equipment, and you may not allow any lien or encumbrance to be created over the equipment.
9. Cancellation Policy
9.1 Goodwill 7-Day Cancellation (Optional)
You may cancel within 7 days of booking for a full refund, provided installation has not started.
9.2 Standard Cancellation Terms (Marquees)
Notice Period – % of Total Hire Fee Payable:
• > 90 days: 30% (or deposit, whichever is greater)
• 61–90 days: 50%
• 31–60 days: 75%
• 0–30 days: 100%
9.3 Other Equipment
Non-marquee equipment follows:
• 0–30 days: 100%
• 31–60 days: 50%
• 61–90 days: 25%
9.4 Our Right to Cancel
We may cancel if:
• You fail to pay
• Site is unsuitable or unsafe
• Access is inadequate
• Information provided is inaccurate
• Unsafe weather prevents installation
• You become insolvent
Refunds may be issued minus reasonable costs incurred.
9.5 Labour Availability
In the unlikely event that we are unable to fulfil the booking due to unforeseen labour shortages beyond our reasonable control (including, but not limited to, sudden illness, injury, or unavailability of key personnel), we reserve the right to cancel the hire.
If this occurs, we will:
- Notify you as soon as reasonably possible, and
- Refund in full all monies paid to us to date.
Should this happen, we will refund in full all payments received and will, where possible, assist with alternative suggestions. No further liability will apply.
10. Liability
10.1 What We’re Responsible For
We’re responsible for:
• Work carried out with reasonable care and skill
• Equipment conforming to specification
10.2 What We’re Not Responsible For
We are not responsible for:
• Loss of profit or business
• Consequential or indirect losses
• Damage caused by misuse or failure to follow instructions
• Damage arising from undisclosed site conditions
We do not exclude liability for death or injury caused by our negligence.
11. Alternative Dispute Resolution (ADR)
Zest supports independent ADR options including MUTA’s mediation service.
ADR is optional but can be a quick, fair way to resolve disputes.
12. Governing Law
These Terms are governed by English law. Clients in Scotland or Northern Ireland may bring claims in their local courts.
